1. Overview

GoPickToday.com (“GoPickToday,” “we,” “our Mercedes,” or “us”) respects the intellectual property rights of creators and expects our users to do the same. This Copyright Policy details the procedure for reporting suspected copyright infringement under the Digital Millennium Copyright Act (DMCA), 17 U.S.C. §512, and describes how GoPickToday addresses valid claims.

In accordance with the DMCA, GoPickToday has appointed the following representative to receive notices of alleged copyright infringement:

3. Submitting a DMCA Notice of Copyright Infringement

If you believe that any content hosted on or accessible through GoPickToday infringes your copyright, please provide a written notice containing all of the following elements mandated by 17 U.S.C. §512(c)(3):

  1. Your full legal name, physical or electronic signature, and complete contact details (mailing address, telephone number, and email address).
  2. Clear identification of the copyrighted work you claim has been infringed (or a representative list if multiple works are involved).
  3. Clear identification of the material you claim is infringing, including information reasonably sufficient to let us locate it (such as the exact web link or URL).
  4. A formal statement asserting that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright holder, its agent, or applicable law.
  5. A formal statement confirming that the information in your notice is accurate, and under penalty of perjury, that you are fully authorized to act on behalf of the copyright owner.

Incomplete notices may not be processed under DMCA guidelines.

4. Counter-Notification Procedure

If your content was removed or disabled on our platform and you believe this action was taken due to a mistake or misidentification, you have the right to file a Counter-Notice pursuant to 17 U.S.C. §512(g). Your Counter-Notice must contain:

  1. Your name, physical address, telephone number, and email address.
  2. Identification of the material that was taken down and the specific location where it was displayed before removal.
  3. A statement made under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. A statement confirming that you consent to the jurisdiction of a competent U.S. court for the resolution of this dispute, and that you will accept service of process from the individual who filed the initial DMCA notice or their agent.
  5. Your physical or electronic signature.

Upon receiving a legally compliant Counter-Notice, GoPickToday may restore the disputed content within 10 to 14 business days, unless the original complainant notifies us that they have initiated a court action seeking a restraining order against the user regarding the allegedly infringing activity.

5. Repeat Infringer Policy

GoPickToday reserves the right to suspend, limit, or permanently terminate account access for any user determined to be a repeat infringer or who continually violates intellectual property laws and our Terms of Service. Determinations regarding repeat infringement status are made at the sole discretion of GoPickToday.

6. Misrepresentations and Abuse

Per 17 U.S.C. §512(f), any individual who knowingly misrepresents that material is infringing or was removed by mistake in a DMCA notice or Counter-Notice may be held civilly liable for damages, including administrative costs and reasonable attorneys’ fees. Submitting deceptive, fraudulent, or abusive claims may result in a permanent ban from our Services.

7. Removal and Restoration Policy

GoPickToday retains the right to remove, alter, or block access to any content suspected of infringement at any time without prior warning. We also reserve the right to retain records or copies of deleted material for compliance and internal documentation. Nothing within this policy restricts GoPickToday’s independent authority to remove content for reasons completely unrelated to copyright claims.

8. No Legal Advice

This policy is published strictly for informational purposes and does not constitute formal legal counsel. If you are uncertain whether materials hosted on our site infringe upon your intellectual property rights, you should consult with a qualified attorney before submitting a formal claim.

9. Arbitration and Dispute Resolution

Any disagreements, claims, or controversies stemming from or relating to this Copyright Policy will be resolved via binding, confidential arbitration under the rules of a mutually agreed-upon arbitration provider. Each party will cover its own legal fees and associated costs unless the arbitrator dictates otherwise. If arbitration is legally unfeasible, remaining disputes will be resolved within a competent jurisdiction chosen at the sole discretion of GoPickToday.
